If the above steps were <br />unsuccessful, PCC would either open the Northwest Intake Portal to assure the water <br />would Flow freely from the mine or drill a hole into the mine so a dewatering pump could be <br />installed. <br />Unreclaimed Coal Mine Refuse Piles <br />The runoff containment ditches associated with the refuse piles have functioned as <br />designed for a number of years. The DMG contends there is a potential For containment <br />ditch failure which would allow refuse laden water to flow directly into Coal Creek. The <br />DMG's failure scenario is based on the assumption the containment ditches are left in the <br />current condition, without reclamation or maintenance. Since PCC continues to maintain <br />the containment ditches, the DMG's failure scenario is flawed and therefore invalid. <br />Coal Creek Channel Improvements <br />The coal creek channel has also passed the test of time. Improvements are planned and <br />will reduce the small risk associated with channel failure. <br />Structures <br />The DMG notes various structures are located at the Roadside Mine South Portal Area, <br />the Roadside Mine North Portal Area and the Unit Trafn Loadout. The DMG contends the <br />structures may be attractive to passers by and present a fall hazard If climbed. <br />The preparation plant and transfer tower located at the Roadside Mine South Portal are <br />locked to preclude public access. The unit train loadout tower has MSHA approved stairs <br />and railing so its presents little fall hazard. The same is true for the screening and <br />crushing building at the North Portal and the walkways associated with the conveyors. <br />PCC does not believe there are any extraordinary fall hazards associated with the <br />structures since they were designed to meet appropriate safety regulations. <br />Open Mine Portals <br />The two Roadside Mine South Portals have been Fenced so persons cannot be exposed to <br />rock fall hazards. The roof is supported between the surtace and seals so rock fall <br />hazards are minimal. <br />
