Under <br />the terms and conditions of this Agreement, Western-Utah <br />and Deseret, through Western-Utah, will pay the full costs <br />associated with their projects and related activities, so <br />that existing residents and the Governmental Entities will <br />be in the same taxing and user fee position during project <br />construction and operation that they would have been in <br />but for the projects and activities of Western-Utah and <br />Deseret. <br />2. Western-Utah and Deseret, through Western- <br />Utah, will be financially responsible for providing the <br />capital facilities which will be utilized by the project- <br />related and induced population. In some cases, new or <br />improved capital facilities will need to be constructed, <br />upgraded, or expanded immediately or. in the near future <br />in order to accommodate the project-related and induced. <br />population. In such event, western-Utah will provide <br />the financial resources for such construction, upgrading <br />(t l" hxl~i,na.luu unclrt the l.Crms ~utd conditions of this <br />Agreement. In other cases, because o: excess capacity <br />in existing facilities, expansion of such facilities can <br />be deferred until the relevant Governmental Entity de- <br />termines that such capacity is needed to service new <br />residents or to provide adequate margins for anticipated <br />growth.
