<br /> <br />- 24 - <br />Western-Utah's obligation pursuant to paragraph 3.16 of <br />this Agreement shall be adjusted to take account Pro rata <br />of the peak project-related population theretofore deter- <br />mined by multiplying the amount by which the project-related <br />population exceeds fifteen hundred (1500) persons by twenty- <br />five (25) percent and adding that number to three hundred <br />seventy-five (375), to arrive at the number of students <br />for whom Western-Utah has a capital obligation pursuant to <br />paragraph 3.16 of this Agreement. <br />3.18 As part of the monitoring program described <br />more fully in Article VI of this Agreement, it shall be <br />determined on a quarterly basis whether the peak project- <br />related population is in excess of that determined in <br />accordance with paragraph 3.16 of this Agreement or para- <br />graph 3.17 of this Agreement. If as part of the monitor- <br />ing program it is determined that the peak project-related <br />population is or has been greater than fifteen hundred <br />(15DD) persons or greater than the amount determined in <br />accordance with paragraph 3.17 or this paragraph of this <br />Agreement, Western-Utah shall pay to the School District <br />within thirty (30) days an amount determined by multiplying <br />the difference betcaeen twenty-f.ive (25) percent of the peak <br />project-related population so determined and twenty-five <br />(25) percent of the peak project-related population used <br />to determine the payment pursuant to paragraph 3.16 of this <br />Agreement times the per capita amount determined in accor- <br />dance with paragraph 3.16 of this Agreement. <br />3.19 At such time as the School District deter- <br />mines to undertake any capital expansion contemplated by <br />paragraph 3.16 of this Agreement, it shall consult with <br />western-Utah to determine whether western-Utah prefers to <br />
