- 23 - <br />3.15 Western-Utah and Deseret, through Western- <br />Utah, agree that, to accommodate a project-related popu- <br />lation of fifteen hundred (1500) or more persons in Rio <br />Blanco County, the School District will be required to <br />upgrade and expand its facilities. <br />3.16 To ensure that Western-Utah and Deseret, <br />through Western-Utah, fulfill their obligation to pro- <br />vide financial resources sufficient to allow expansion <br />of the School District's facilities, Western-Utah agrees <br />that at such time as the School District, using sound <br />management principles, determines that an expansion of <br />its facilities is necessary, western-Utah shall pay to <br />the School District an amount equal to the then Western <br />Colorado average per student capital cost for school <br />construction, as determined by averaging on an equal <br />basis the per student average cost of elementary school <br />construction and equipment and fixtures and the per stu- <br />dent,_~verage cost of high school construction and equip- <br />ment and fixtures, multiplied by three hundred seventy- <br />five (375) students, provided, however, that the obliga- <br />tion set forth in this paragraph shall, if appropriate, <br />be adjusted in accordance with paragraphs 3.17 and 3.18 <br />of this Agreement and shall be fulfilled in accordance <br />with paragraph 3.19 of this Agreement. <br />3.17 In the event that prior to the time that the <br />School District determines to undertake any expansion of <br />its capital facilities, as contemplated by paragraph 3.16 <br />of this Agreement, it shall have been determined in accor- <br />dance with the monitoring program described more fully in <br />Article VI of this Agreement that the peak project-related <br />population has exceeded fifteen hundred (1500) persons, <br />
