-la- <br />3.6 As part of the monitoring program more fully <br />described in Article VI of this Agreement, it shall be <br />determined on a quarterly. basis whether the project- <br />related population has reached a level even higher than <br />the peak level of project-related population determined <br />pursuant to paragraph 3.5 of this Agreement. This shall <br />be done to determine whether additional capital contri- <br />butions by Western-Utah, in addition to the capital con- <br />tributions set forth in paragraphs 3.3 and' 3.5 of this <br />Agreement, are required. Each time that a new, higher <br />peak level of project-related population has been attained, <br />Western-Utah and Deseret, through Western-Utah, shall <br />make an additional per capita payment in accordance with <br />the following formula: <br />(a) The peak project-related population <br />shall be compared to the peak project-related popula- <br />tion previously determined pursuant to paragraph 3.5 of <br />""' this Agreement or pursuant to this paragraph, to deter- <br />mine the number of persons for whom a per capita capital <br />payment has not been made by Western-Utah. <br />(b) The number arrived at pursuant to sub- <br />paragraph (a) of this paragraph shall be multiplied by <br />the per capita capital payment determined pursuant to <br />subparagraph (a) of paragraph 3.5 of this Agreement, as <br />adjusted for inflation. <br />Western-Utah shall then pay, no later than thirty <br />(30) days following the date on which the project-related <br />population was determined to exceed the peak population <br />determined in accordance with paragraph 3.5 or this para- <br />graph of this Agreement, the amount computed in accordance <br />with subparagraph (b) of this paragraph. <br />
