<br /> <br />- 19 - <br />ARTICLE II <br />DURATION <br />2.1 This Agreement shall become effective when <br />executed and shall remain effective until such time as <br />operations cease at the Piine. <br />2.2 Notwithstanding the provisions of paragraph <br />2.1 above, Western-Utah may request the County to recon- <br />sider and amend the provisions of this Agreement as in- <br />corporated in the Special Use Permit on the ground that <br />the County is not applying fairly and equitably its policy <br />to require mitigation of adverse socioeconomic impacts <br />as described in Paragraph 4 of the Recitals above through <br />its Special Use Permit process in the case of another <br />energy development project similar in size, tax base, <br />anticipated fiscal and other socioeconomic impacts, and <br />other relevant respects. If so requested, the County <br />will consider in good faith any facts and arguments <br />brought to its attention in support of reconsideration <br />and amendment, taking into account all relevant similar- <br />ities and differences between the Project and the other <br />development; provided, however, that any relief requested <br />under this paragraph will be prospective in nature only <br />and shall not refer to or affect any payment theretofore <br />made or payable prior to the request; and provided <br />further that, if another Governmental Entity is affected <br />by the request, that Governmental Entity must expressly <br />agree to any relief which may be granted by the County <br />before such relief can be granted; and provided further <br />that the granting of any relief under this paragraph <br /> <br />
