' • - 11 - <br />funding of a monitoring system periodically to review the <br />demographic changes associated with the projects and to <br />gather and analyze other data related to the socioeconomic <br />impact of the projects. <br />W. Since. a decision has been made at this time to <br />construct only Unit 1 of the Power Plant, this Agreement <br />addresses in substantive detail below only the impacts <br />anticipated from construction and operation of Unit 1 of <br />the Power Plant and the mining and transportation activity <br />associated therewith. Western-Utah agrees that, if a de- <br />cision should be made to construct one or more additional <br />units at the Bonanza Station, requiring or resulting in <br />increased coal production by the Mine, Western-Utah will <br />be required to seek an amendment to this Agreement and to <br />its Special Use Permit for the Deserado Mine pursuant to <br />which Western-Utah will be reouired, after consultation <br />with and agreement by the Governmental Entities, to adopt <br />and implement fully a socioeconomic mitigation program <br />based-upon and fully implementing the principles agreed <br />to in this Agreement, including particularly the provi- <br />sions of paragraph R above, and using identical or sub- <br />stantially similar mechanisms designed to achieve similar <br />results. These requirements and undertakings will be <br />embodied in a new or amended Special Use Permit and shall <br />be fully enforceable against Western-Utah under this <br />Agreement, as appropriately modified. <br />X. This Agreement and all the terms and conditions <br />thereof shall be incorporated in a Special Use Permit to <br />be issued to Western-Utah by Rio Blanco County and will <br />be enforceable pursuant to the provisions thereof, as well <br />as enforceable as a binding contract between and among the <br />parties. <br />
