State reclamation permits do not address days or hours of operation. Those are usually under a local authority, such <br />as either the town or county. <br />I~'~ ~_. <br />Likewise, this agency does not regulate exhaust from diesel equipment. Operators are to obtain APENs, or Air <br />Pollution Emissions Notices, from the Air Pollution Control Division, in the Colorado Department of Public Health <br />and Environment. <br />This operator, acfing as the landowner, has certain rights to carry out a variety of activities on the property. But <br />when any of those activities (such as excavating gravel) fall under the purview of a regulatory authority, and a <br />permit is obtained voluntarily (such as this one) there are limitations imposed on some of those activities. In this <br />case, he has a permit which defines his allowed onsite activities, where they may occur and in what order. This <br />agency has the authority to require a bond to be posted, and to monitor the operation to ensure compliance. Since <br />problems were identified during the last inspection, for which several con•ective actions were ordered, several <br />follow-up inspections will be carried out during the correction period. The operator's bond amount will also be <br />recalculated, and any increased amount will be additionally required. Many of the problem items explained in this <br />letter were communicated to the operator in my inspection report or 5/7103, to which I am expecting timely on-the- <br />ground compliance and written responses. <br />I hope I have answered your questions, at least the ones involving topics under our jurisdiction.
