op Adjustment `°`~` ` <br />Ikrard 1976 • <br />J.uur,rr,' ~ r <br />r,-,r~~~5-I (continued) <br />id <br />1 <br />i <br />r <br />1 <br />There was question and discussion regarding Section 25-C-5-9 of the <br />lorring Resolution pertaining to limitations on hours for operations <br />that are within 1000 ft. of a residence and the fact that this par- <br />ticular operation is at least 3500 ft. from the nearest residence. <br />Cork;V Shields, Board's Counsel, said that the Board can still limit <br />Aour:s if they can justify the restriction, but if Hours don't adversely <br />affect the surrounding residents or area, they could have practicaliy <br />unlimited hours. <br />Members of the Board explained that the limitation had been imposed <br />for the 'public safety based on their feeling that there is additional <br />traffic in the area on weekends with people going to and coming fr•onr. <br />the mountains. The permit is for a 5 year period. Looking at th~~ <br />potential increase in traffic connected with the future developme~~t of <br />the Mt. Carbon Dam and Recreation area. The possibility of givinrl an <br />economic advantage if hours were uniirr~ited on this operation :vhen others <br />have to work under hourly limitations, <br />Further discussion included the fact that other operations have been <br />found to definitely adversely affect the public welfare and must be <br />limited which is not necessarily the case with the Cooley operation. <br />LOCATION OF EQUIPMEN7: <br />The resolution stipulates that location, number and types of crushers <br />and conveyors can not be altered without permission from the Board. <br />The applicants feel that this wording will delay operations and seriosly <br />handicap their business since they are continually altering the number <br />and type of equipment for production and quality control. <br />They agree to confine the location of all equipment within the quarry <br />er.cavation and plant site, but don't want to have to get permission <br />from the Board on the size, how many, and where the various pieces of <br />equ ipment can be located and used. <br />GROWiH ACCEPTANCE/ACCESS ROAD: <br />The resolution stipulates that slopes along the cuts and fills on the <br />access road from Colo. Hwy. 8 must be seeded and reseeded until cror•,th <br />is acceptable to the Board. <br />The applicants don't want this confined to the opinion of the Board and <br />feel it should be also based on other outside competent and expert <br />opinions. Mr. Holley's opinion was that the Board's opinion would leave <br />to be based on reason and not arbitrary or capricious and withdrew the <br />objection to this stipulation. <br />Discussion by the Board included the possibility of adding wording that <br />nothing unreasonable would be imposed, or at the recommendation of the <br />County Extension Agent, or that acceptance would not be unreasonably <br />withheld. <br />Mr. Ingram failed to see the concern with just this item regarding <br />the access road when the same or similar wording appears in other parts <br />of the resolution as far as things being acceptable to the Board. <br />SLOPING BCNCII FACCS ON TOP 3 BE?ICIIES: <br />The resolution stipulates that the top 3 benches must have slopes or <br />faces sloped •[o soften the visual effect and' provide for some type of <br />growth.
