:-

5. Road Re-establishment
Now that the lowermost 310 feet of the road has been re-
established, the permit needs to reflect this fact. A letter
to the Division together with a minor revision to update
Section 4.03; "Roads", page 22 is necessary. A minor revision
form is included for your convenience.
Since the road has been re-established, and it is now possible
to drive to the Rex Carbon portal for inspections, would it
also be possible for the Division to obtain a key for the gate
to access the mine site? A key to the gate and vehicular
access would definitely reduce the time spent conducting
inspections on the mine site and eliminate the need to walk
the length of the road. Should you agree to provide the
Division with a key, the Division will agree to inform your
office just prior to the inspection, that an inspector will be
on the site. Thank you for considering the matter.
6. Phase II Issues
As promised, the Hydrology Task Force will meet tomorrow to
discuss the two Phase II issues, mainly removal of the
diversion ditches and final pond certification after removal.
I will let you know the decision next week on these two items.
The Division is awaiting a copy of the proof of publication to
be submitted to our office. Upon receipt of the proof of
publication, the Division will begin to coordinate a time for
a Phase II site inspection at the Newlin Creek site.
This concludes the brief on issues outstanding. Thank you for your
continued cooperation and patience.
Sincerely,
awn E. Smi
Environmental Protection Specialist
w/enclosures
ses/newlncor.94
