Simpson, Deputy Stale Engineer <br />SUBJECT: Puebla East Pit, Valco Pueblo Concrete Division, File No. M-86-015 <br />E1/2 NE1/4, Sec. 34 and SWl/4 Nwl/4, Sec. 35, T20S, R64W <br />As requested, we have reviewed the above references application for a permit <br />to mine sand and gravel an 66 acres approximately 1 1/4 miles east of Pueblo, <br />Colorado. Aground water pons will be creates by this operation. This pone <br />will be used as haoitaC for fish and wildlife. - <br />Using an impoundment of water for recreational purposes, incluuiny fishery and <br />wildlife; has been defined in .Section 37-y2-103, CRS {1973}, as putting the <br />water to beneficial use. Since the source of water for the pdnD that will oe <br />creates by the gravel pit operation is yround water and the ground water will <br />be used beneficially, we require that a well permit oe ootained from our <br />office. The well permit must be obtained prior to excavation of the gravel <br />pit. Otherwise, Valco, Inc. will be in violation of Section 31-9U-1'37, CRS <br />(1913). Since the proposed gravel pit would be located in an over-appro- <br />priateD basin, the well permit cuulD not be cotained until a court approved <br />°Plan for augmentation means a detailed proyram to increase the supply df <br />water available for beneficial use in a division or portion thereof by the <br />development of new or alternate means or points of Diversion, by a pooling of <br />water resources, by water exchange projects, by providing substitute supplies <br />of water, 6y the development of new sources of water, or by any other appro- <br />priate means...° (Section 37-92-103(5), CRS (1973)). Valco, Inc. shoulD <br />devise an augmentation plan to replace the out-of-priority consumptive use <br />associated with pond evaporation and other out-df-priority consumptive uses of <br />water. <br />Valco, Inc. has provided insufficient <br />in the mining operation. In order for <br />the quantities of water to be used far <br />poses. we would also need to know the <br />information concerning the use of water <br />us to comment, we would need to know <br />dust control, washiny, aqD other pur- <br />sources of water for the operation and <br />~ EXF~IBIT <br />
