<br />Permanent access road specifications include 20 foot travel width, gravel surfacing, seeded <br />cut and fill slopes and appropriate drainage structures including culverts at specified <br />locations. The current permit does not clearly specify completion deadlines for permanent <br />road construction. The Division requested such commitment, and SCC has provided <br />information within TR-50 (submitted December 1, 2004 and currently under review). Plans <br />within TR-50 indicate that grading associated with construction of permanent road <br />segments that are not yet completed would be conducted in accordance with the following <br />schedule: <br />Road "G" from C.R. 53 to start of Ridgeline Road: 2005 <br />Ridgeline Road (unfinished segments at north and south end): 2005 <br />Road "J" 2010 <br />Road "A" 2010/2011 <br />Question (prompted by TR-45 proposed decision publication>; Js this the decision on our <br />item 2 above? What are the Stipulations #31, 32, & 33J Can we p/ease see maps <br />showing these proposed permanent design decisions? <br />TR-45 was submitted by SCC to address the requirements of Stipulations 31 and 33, and <br />also to revise the drainage channel configurations and designs within the original portion of <br />the permit area. <br />Stipulations 31, 32, and 33 were attached to the Division's .proposed decision on TR-42. <br />That proposed decision was issued 10/14/03. TR-42 provided initial designs or design <br />modifications for various access roads and light use roads within the permit area. The <br />specific wording of the stipulations is: <br />STIPULATION 31 <br />THE PERMITTEE WILL SUBMIT, WITHIN A COMPLETE REVISION APPLICATION, AN <br />APPROPRIATELY AMENDED EXHIBIT 13-2A, ACCURATELY DEPICTING THE <br />LOCATION OF THE LIGHT USE ROADS ASSOCIATED WITH SEDIMENTION PONDS <br />16, 16A, AND 17, BY NOVEMBER 28, 2003. <br />STIPULATION 32 <br />FOR PERMANENT ROAD RETENTION ON RECLAIMED LANDS, THE PERMITTEE <br />WILL SUBMIT, WITHIN A COMPLETE REVISION APPLICATION, DEMONSTRATION <br />OF COMPLIANCE WITH 4.03.1(11(f) OR 4.03.2(1)(8) AS APPLICABLE. THE <br />DEMONSTRATION WILL INCLUDE COPIES OF SIGNED LANDOWNER REQUESTS <br />FOR ROAD RETENTION FROM EACH AFFECTED LANDOWNER. ALL ROADS OR <br />SEGMENTS OF ROADS REQUESTED FOR RETENTION WILL BE IDENTIFIED <br />CONSISTENT WITH DESIGNATION IN THE PERMIT APPLICATION (HAUL ROAD G, <br />RIDGELINE ACCESS ROAD, OIL WELL ACCESS ROAD, ETC.) THE ROAD <br />RETENTION DEMONSTRATION WILL BE SUBMITTED TO AND APPROVED BY THE <br />DIVISION PRIOR TO APPROVAL OF PHASE 1 BOND RELEASE FOR ANY <br />RECLAMATION PARCEL THAT INCLUDES A ROAD OR ROAD SEGMENT TO BE <br />RETAINED FOR THE POSTMINING LAND USE. <br />STIPULAT)ON 33 <br />THE PERMITTEE WILL SUBMIT, WITHIN A COMPLETE REVISION APPLICATION, A <br />RELEVANT SHOWING STATEMENT IN LIEU OF CERTIFICATION FOR THE COAL <br />
