the beginning of mining operations, topsoil will be stripped and stockpiled <br />separately from overburden. Topsoil will be used to form berms around <br />the perimeter of the proposed operation. The topsoil berms will be graded <br />at 2:1, seeded with a mixture of crested wheatgrass, pubescent wheatgrass <br />and orchard grass as soon as possible after placement, and watered as <br />needed to prevent erosion and control dust. Once mining is completed, the <br />topsoil will be redistributed over the site in depths comparable to the <br />existing topsoil depth. The Applicant has stated that there is ample topsoil <br />on the site to complete the reclamation plan and that no additional topsoil <br />from off-site sources will be required. <br />4. The weight of the evidence demonstrates that the Applicant has met the <br />minimum requirements of Construction Materials Rules 3.1.9 and <br />6.4.5(2)(d). <br />F. Will Reclamation Plan Achieve Final Land Use ofCronland? <br />1. Construction Raterials Rule 3.1.1 requires the proposed reclamation plan <br />to achieve the final land use proposed, in this case cropland. <br />2. The Objectors assert that the Applicant failed to comply with the <br />minimum requirements of Construction Materials Rule 3.1.1. <br />3. The Applicant intends to grade the pit floors to 2% over 156 acres, which <br />approximates their current grade. According to the Applicant, this slope <br />will allow farm equipment to traverse the area.
