Collins, Co. 80521 <br />RE: Newett Quarry <br />File #78-93 <br />Dear Mr. Brownhi2l: <br />As per our meeting of April 2, I am sending this letter updating <br />information regarding the above mine. I have researched several items <br />and will comment accordingly. <br />Mining Plan <br />Your decision to mine area B instead of area A is considered to be a <br />Technical Revision (Rule 1.9). I wi1Z place this change on the April <br />Board agenda for formal Board approval of this change. <br />It is important that your crews follow the mining plan as stated in <br />your application(s). Otherwise, a company is subject to fines and pos- <br />sible permit revocation (Rule 8.22). If there are to be changes, this <br />can be accomplished by simply sending us a note of the changes for a <br />Technical Revision to the plan. <br />Please make sure the people operating the equipment make an effort <br />to salvage all available topsoil for stockpiling (Rule 6.9(a)). Obviously, <br />if topsoil is not salvaged, the probability for successful reclamation <br />decreases; with the possibility of surety forfeiture. <br />We acknowledge that the proposed haul road to O.S. 285 may still <br />be constructed sometime in the future. <br />Surety <br />Minutes from the July 1978 MLR Board meeting indicate that a floating <br />bond was approved for this operation but do not indicate the acreage limi- <br />tations. <br />Because we wish to update the bond on this operation, I spoke with the <br />Assistant Attorney General, Lew Woods, seeking advice on how best to re- <br />write this. <br />
