II. SUMMARY OF REVISIONS AND STIPULATIONS <br />Stipulations <br />Stipulation No. 22, which was incorporated through previous permitting actions, was included in the <br />most recent decision document. There are no additional stipulations attached to the permit. <br />Stipulation No. 22 requires specific documentation to be provided prior to initiation of mining within <br />the subsidence angle of draw beneath the 345 KV Rifle-San Juan Powerline, within the South Portals <br />mining area. Mining operations have ceased, and the portals have been sealed. As such, it is likely <br />that the concerns addressed by the stipulation will not be realized. The stipulation is retained as a <br />precautionary measure, in the unlikely event that operations would re-initiate in the future. <br />Revisions <br />The Division processed the following revisions subsequent to issuance of the Renewal 04 proposed <br />decision. <br />Technical Revisions <br />TR-43 approval decision was issued December 1, 2003. The revision amended the approved <br />reclamation schedule, allowing for completion of reclamation at the South Portal facility area in 2005 <br />rather than 2004, to allow the operator additional time to market the property with facilities in place. <br />TR-04 approval decision was issued December 15, 2004. The revision amended the approved <br />reclamation schedule, allowing for completion of reclamation at the South Portal facility area in 2006 <br />rather than 2005, to allow the operator additional time to market the commercial value of existing <br />facilities. <br />Miner Revisions <br />MR-65 approval decision was issued December 1, 2003. The revision amended Table 3.9 listing of <br />required licenses and permits to include the U.S. Army Corps of Engineers Nationwide General Permit, <br />required for demolition of the suspended conveyor across the Colorado River. <br />MR-66 approval decision was issued July 13, 2004. The revision provided documentation of all <br />seedmixes previously used within the permit area, along with applicable sites and timeframes. In <br />addition, Exhibit 7C was amended to depict the Union Pacific railroad maintenance road, and Exhibit <br />49 was amended to reflect minor boundary changes to the Greasewood Reference Area and the <br />Shadscale Reference Area. <br />MR-67 approval decision was issued September 22, 2004. The revision authorized installation of a 6 <br />inch diameter flexible pipe to drain a small low spot on top of the RSRDA refuse area, as an interim <br />measure prior to final reclamation of the top of the refuse area. <br />MR-68 was submitted February 28, 2005 and withdrawn by letter dated March 10, 2005. The <br />revision application addressed various changes to the approved reclamation plan, including remedial <br />seedmixes for specified locations, plans for cheatgrass and tamarisk control, and a proposed <br />modification to the species diversity standard. The proposed modifications were based on information <br />presented in the 2004 annual reclamation report, and the Division's review of the subject report. Due <br />5 <br />
