<br />-2- <br /> <br />Section XVIII: Coal Processing Waste and Non-Coal Processing Waste (2.05.3(8) <br />2.05.4(2)(f), 4.10, 4.11) <br />The application includes proposals to dispose of coal processing waste within <br />abandoned underground workings through an experimental slurry disposal <br />system. In addition, coarse wastes, including bone coal, rock stringers <br />and roof and floor debris, are separated from product coal utilizing a <br />breaker. This "coal processing waste" is currently disposed of at an approved <br />land fill site adjoining the Delta County Landfill. However, according to <br />Western Slope Carbon's design calculations, this approved coal processing <br />waste disposal site will reach design capacity and is scheduled for reclama- <br />tion by spring of 1983. Because of the experimental nature of the proposed <br />slurry disposal system and the limited life expectancy of the currently <br />approved coal processing waste disposal site, the Division deems it appropriate <br />to impose the following stipulation upon permit approval. <br />Stipulation No. <br />THE DIVISION DIRECTS [•JESTERN SLOPE CARBON TO SUBPfIT PLANS, INCLUDING <br />APPROPRIATE GEOTECHNICRL INVESTIGATION AND STABILITY ANALYSIS, FOR <br />A COAL PROCESSING WASTE DISPOSAL FACILITY TO BE UTILIZED SUBSEQUENT <br />TO THE COMPLETION OF THE CURRENTLY APPROVED LANDFILL SITE. A GENERAL <br />PLAN SHALL BE SUBMITTED TO THE DIVISION FOR REVIEW WITHIN 3 MONTHS <br />FOLLOWING ISSUANCE OF THIS PERFfIT. <br />FURTHER, A DETAILED ENGINEERING PLAN FOR THE PROPOSED WASTE DISPOSAL <br />FACILITY, INCLUDING THE APPROPRIATE CEOTECHNICAL INVESTIGATION AND <br />STABILITY ANALYSES, SXALL BE SUBMITTED TO THE DIVISION WITHIN 3 <br />MONTHS FOLLOWING APPROVAL OF THE GENERAL PLAN BY THE DIVISION. <br />Division staff members have determined, during inspection activities at the <br />Hawk's Nest mine site, that the portal bench and wash plant embankment within <br />the surface facility area at the east portal contain embankments constructed <br />primarily of coal processing waste. Upon final reclamation, this coal <br />processing waste material will have to be properly disposed of in a stable <br />structure which conforms with the requirements of Rule 4.10. Further, the <br />toxicity of the material will have to be determined, in order to ascertain <br />appropriate non-toxic cover requirements, in accordance with Rule 9.06.2. <br />Because the material and disturbance in the area of the east portals exist <br />in their proposed configurations, the Division deems it appropriate to remedy <br />this deficiency by imposing the following stipulation upon permit approval. <br />Stipulation~No. <br />THE DIVISION DIRECTS WESTERN SLOPE CARBON TO DEVELOP A PLAN FOR THE <br />PROPER DISPOSITION OF ~'HE COAL PROCESSING WASTE MATERIAL CURRENTLY <br />EXISTING WITHIN THE SURFACE FACILITIES AREA AT THE EAST HAWK'S NEST <br />MINE, INCLUDING, BUT NOT LIMITED TO, TXE PORTAL BENCH AND WAIN PLANT <br />EMBANKMENTS. THIS PLAN SXALL DEMONSTRATE CONFORMANCE WITH TXE <br />REQUIREMENTS OF RULE 4.06.2, 4.10, 4.11, 4.14 and 4.27, AS APPROPRIATE. <br />THIS PLAN SXALL BE SUBMITTED TO THE DIVISION FOR REVIEW AND APPROVAL <br />WITHIN 6 MONTHS FOLLOWING ISSUANCE OF THIS PERAfIT. <br />ldith the imposition of these stipulation, the application is found to be in <br />compliance with Rules 2.05.3(8), 2.05.4(2)(f), 4.10 and 4.11. <br />
