Item 2 -South End Ditch, PAD for Riprap, Shaping of Ditch - $1230.00 <br />The permanent rewnstructed ditch at the south end of the east pit was not well <br />defined after the east and west highwalls were graded. Several storms between <br />5/5/94 and 5/7/94 produced enough flow to wash away sand and silt, exposing riprap <br />occurring in the ditch. Division of Minerals and Geology personnel determined that <br />the ditch had not been graded according to Drawing #4 and asked the contractor to <br />widen and shape the ditch. This grading work is covered under Task #12, Pazagraph <br />#2 of the work description, and no payment will be made for this item. <br />2. On 5/11/94 it was decided to remove additional riprap and erosion mat from the <br />above mentioned ditch, and the contractor was verbally informed. A change order <br />reflecting this was written on 5/26/94. However, the contractor refused to sign it, <br />primarily because of the reduced time associated with removal of these items. Work <br />to level a bench for storing and sorting riprap was done prior to the change order, <br />without consultation with the project manager. The need fora "staging pad" is <br />questionable, as there is ample room on the floor of the East Pit for sorting and <br />storing riprap. No payment will be made for this item as this work was not requested <br />by the project manager or specified in the project work description of the Invitation <br />and Bid. <br />C. Item 3 - 200 Cubic Yazds of Stockpiled Riprap - $Sb16.00 <br />1. Three sepazate "stockpiles" of riprap aze present at the north end of the East Pit, and <br />comprise approximately 165 cubic yazds, by measurement. North to south they are as <br />follows: Stockpile #1, approximately 50 cubic yazds, all oversize (15"+) rock mixed <br />with approximately 25% pit run sand and small rock. Stockpile #2: approximately 70 <br />cubic yazds all oversize (15"+) rock. Stockpile #3: Approximately 45 cubic yazds, <br />90% of which falls within specifications of 8" - 15" diameter, and can be used to <br />complete the riprap portion of Chen's Hill Ditch, which is currently unfinished. No <br />payment will be made for this item. <br />D. Item 4 -Concrete Drop Structures - $800.00 <br />1. Although the Invitation and Bid document makes no reference to stream flow <br />direction in relation to a concrete drop structure, it was verbally explained to the <br />contractor that the point of the V is upstream. The contractor attributes the <br />misorientation of the drop structures to a "misunderstanding". If the contractor had <br />any question whatsoever concerning the structure it was his duty to bring it to the <br />Project Manager's attention, as required in Pazagraph #11, p. b of the General <br />Conditions. Because of the incomplete description in drawing #3, the Division of <br />Minerals and Geology will pay one-half of the requested amount, or $400.00, upon <br />receipt of an invoice. <br />
