I ong <br />Division Director <br />RE: GEC East Pit Project <br />Dear Mr. Mease: <br />Thank you for your letter of July 19, 1994, wherein you provide a breakdown of additional items <br />that you believe are billable. Each of your items was carefully reviewed for consideration of <br />payment. Our response is outlined below in the same order as your letter. <br />A. Item 1 - 4.5 Hours at 590.00/hr Dozer Rental -5405.00 <br />1. Water bars at the south end of the East Pit were located on a steep section of road <br />that originated on the west side of the pit, near the south topsoil stockpile. It crossed <br />the drainage above the original highwall and connected the east side of the pit with <br />the west. Construction of this road was not necessary, other than for convenience of <br />the contractor, and it was not part of the project work description. To avoid serious <br />erosion of the slope where the road was located, the contractor was asked to install <br />several water bars prior to revegetation of the site. This restoration is provided for <br />under Task #1, Paragraph #2 of the Invitation and Bid, and no payment will be made <br />for this item. <br />2. Construction activity near Magpie Creek and the staging area resulted in coal <br />overburden spoil covering a small portion of undisturbed ground, south of the road, <br />on Energy Fuels permitted road right-of-way. The contractor was asked to grade and <br />topsoil this area. This work was covered under Task #1 of the Invitation and Bid and <br />no payment will be made for this item. <br />3. Prior to construction of the north end road the contractor was told by Messrs. <br />H. Raney, J. Nelson and J. McArdle, at various times, that the road was to be sloped <br />into the hill at a 2% grade. The slope was not done correctly when the road was <br />initially cut, resulting in a second grading effort by the contractor. The Division of <br />Minerals and Geology will not make additional payment to remedy work items <br />initially done incorrectly. Payment for this item, an important part of Task #8, has <br />already been made. <br />
