This is acceptable; however, the 100- to 400-foot setback <br />limits are not properly shown on the plans. The setbacks have to be measured <br />from the top of existing banlry or from the top of master plan bank, whichever is <br />farthest away from the river. The.plan needs to be revised accordingly before <br />approval. I have enclosed a sketch of the 100- to 400-feet we feel is acceptable <br />now. This is especially important along the west bank of the river at the McKay <br />Road and 104th Avenue bridges. Preliminary plans call for new longer bridges. <br />Therefore, the mining and reclamation setbacks need to start from the master <br />plan channel bank alignment (i.e., proposed west side bridge abutments), not the <br />100-foot minimum setback as shown on Exhibit C-2. <br />2. On Exhibit C-2, Haring Plan Map, the Phase lA and 1B areas show a note that <br />reads "no mining within 35' of the top bank S. Platte River." The minimum <br />setback allowed is 100 feet with both riverbank and pitside bank protection. A <br />variance may be allowed if the applicant can guarantee that they mine and <br />immediately reclaim the area witlun the 100-foot setback during one low flow <br />season (generally October through March). <br />iii iiiiiiiiiiiu iii <br />L.
