INTRODUCTION <br />This document is the approval package proposed by the Colorado Division of Minerals and <br />Geology (Division) for the complete Phase I, II and III release of reclamation liability and <br />reclamation bond for the Santa Fe Loadouts No. 1 and 2 permitted under the Raton Creek <br />Mine, Permit No. C-82-055. This package contains three para. These include: 1) a <br />summary of the review process history; 2) written findings of the Division regarding <br />compliance with the requirements of the Colorado Surface Coal Mining Reclamation Act <br />34-33-101 et. seq., C. R. S. 1973 as amended, and the regulations promulgated thereunder; <br />and 3) the final proposed decisions to approve the request for Phase I, II and III bond <br />release. <br />Detailed information about the review process can be found in the Act and Regulations of <br />the Colorado Mined Land Reclamation Board for Coal Mining. All rules referenced within <br />this document are contained within the Regulations. Detailed information about the mining <br />and reclamation operation can be found in the permit application on file at the Division, <br />1313 Sherman Street, Room 215, Denver, CO 80203, and at the mine site located <br />approximately three miles south of Trinidad. Iuppa, 9580 County Road 69.3, Trinidad, CO 81082. <br />SUMMARY OF THE REVIEW PROCESS <br />Energy Fuels Mining Company, the operator and permittee of the Raton Creek Mine, <br />applied for Phase I, II and III bond release for the Santa Fe Loadouts No. 1 and 2 under <br />the Colorado Surface Coal Mining Reclamation Act. A request for Phase I, II and III bond <br />release represents a release of 100 percent of the reclamation liability bond. The Division <br />holds a bond in the amount of $205,831.00 for reclamation activities remaining for the <br />Raton Creek Mine site and the Santa Fe No. 1 and 2 Loadouts. This bond consists of two <br />corporate sureties drawn off of National Union Fire Insurance Company of Pittsburgh, <br />Pennsylvania, No. 13-20-17, in the amount of $204,524.00, and No. 13-20-18, in the amount <br />of $1,307.00 <br />The Division approved a Phase I, II and iII bond release for reclamation of the Burlington <br />Northern Loadout, on February 28, 1994, in the amount of $7,807.00. The Division <br />approved a Phase I liability release for backfill and grading at the Raton Creek Mine site <br />on April 7, 1995. Due to projected costs associated with remaining reclamation work to be <br />performed in accordance with the approved reclamation plan, no monies were released as <br />per Rule 3.03.1(3)(d), for the mine site Phase I release. On September 5, 1995, the Division <br />approved a reduction in bond, pursuant to Rule 3.02.2(5), in the amount of $17,750.00 for <br />the retention of specific structures located on the mine site (Technical Revision No. 19). <br />At the time of this findings, Energy Fuels Mining Company has not submitted a rider to <br />reduce the bond by $17,750.00. The reclamation liability assessed for all remaining <br />reclamation activities at the mine site and Sania Fe Loadouts is $169,717.00 prior to the <br />release of liability associated with the Santa Fe Loadouts No. 1 and 2. The current bond <br />amount apportioned for reclamation of the Santa Fe Loadouts No. 1 and 2 is $8,963.00. <br />
