The Colorado Division of Wildlife indicated that the bald eagle was the only <br />threatened species in the area and that its habitat would not be disrupted <br />by the mine. Electric transmission and distribution lines within the permit <br />area had been constructed to the specification of Rule 4.18, to ensure the <br />protection of large raptors. <br />16. The Division has contacted the Office pf Surface Mining, Reclamation Fees <br />Branch. At this time, MINREC, Inc., the operator, is Current in the payment <br />of reclamation fees required by 30 CFR Chapter VII, subchapter R <br />(2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4: <br />Z. Roads - Rule 4.03 <br />A. Haul Roads <br />1. The Red Canyon Mine has one haul road which extended from the <br />entrance gate to the old shop. The plan, profile, and cross <br />section of this road can be found on Table 2.05.3(3}(c}(i)-1 and <br />Drawing 2.05.3 (3)(c)(i)-1. <br />The road up to the entrance gate is considered a public road. <br />2. The haul road, except for the portion from the gate to the fork <br />in the road was reclaimed in 1988. The remaining portion, <br />approximately 950 feet, of this road was ripped and seeded in the <br />fall of 1997. The reclamation plan for this road segment which <br />does not include regrading to approximate original contour, was <br />approved pursuant to Technical Revision No. 13, in response to <br />request from the landowner and the Delta Montrose Electric <br />Association (DMEA) DMEA had requested that the road segment be <br />retained to allow future access to a segment of their <br />transmission line right of way, located on the site. The <br />modified reclamation plan will provide for vegetative <br />stabili2ation of the road surface, but will allow for future <br />access by the landowner and DMEA. <br />Pursuant to Rule 4.03.1 (7)(a), the Division is approving <br />retention of the 950 foot haul road segment described in the <br />above paragraph as suitable for the approved postmining land use. <br />Reclamation of the road, other than scarification and seeding of <br />the roadbed, is not required. <br />B. Access Roads <br />1. The Red Canyon Mine had three access roads prior to reclamation. <br />One road provided access past the bath house, up around the old <br />shop, and around the east and south side of the yard.
