Intrr~!u~tic~ <br />Tiiis document presents the results of the Uivision's midterm review of the <br />Meadows No. 1 i•line. This midterm review was conducted to fulfill tie <br />requirements of Rules 2.08.3, 2.06.2(9), 2.Oti.3(4), 2.06.5(3), 2.Ob.7(5), and <br />3.02.2(4). <br />Rule 2.08.3 requires that file Division conduct a review of each permit issued, <br />prior to its midterm (two and one-half years). Based on this revien, iur good <br />cause shown, the Division may require reasonable revision or modification of <br />the permit provisions to ensure compliance with the Act and Regulations. <br />Rules 2.06.2, 3, and 5 require that experimental practices, mouniaintop <br />removal variances, variances from approximate original contour, and variances <br />from contemporaneous reclamation be reviewed by the Division where <br />applicable. The i•1eadows No. 1 Mine permit does not have any operations under <br />these categories. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and <br />the terms of acceptance of the bond every two and one-half years. <br />The midterm review consisted of a detailed review of the Meadows No. 1 Mine <br />Permit. The Division also reviewed subsequent revisions and stipulation <br />responses to ensure that all permit commitments and conditions were being <br />followed. Hydrologic monitoring data was reviewed in conjunction with the <br />review of the application to assess file adequacy of the monitoring plan and <br />discussion of hydrologic impacts. <br />Section I - History <br />Sun Coal Company originally received an approved permit for the Meadows No. 1 <br />Mine on August 9, 1983. The permit was renewed on August 9, 1988. The <br />renewal process was completed and the Findings Document and proposed decision <br />to .approve permit renewal issued on September 7, 1988. The Division's <br />decision to approve the i+leadows No. 1 Mine permit rener+al was subject to four <br />stipulations. The Division first published the proposed decision to renew the <br />permit on September 15, 1988. No public comment was received during the <br />required 30-day comment period, so the proposed decision became final on <br />October 15, 1988. Commencing in 1983, the pit area was backfilled, graded, <br />seeded, and mulched. The reclaimed pit area has undergone Phase I bond <br />release where 60 percent of liability was released in 1984. <br />In March 1985 the haul road reclamation plan was revised and the haul road <br />retained as a permanent structure. In August 1986 the i4ined Land Reclamation <br />3oard released 70 percent of the bona for the haul road. By Board order, <br />March 1989, the Uivision's decision to approve final bond release for the haul <br />road was upheld. The road has been released from the Division's jurisdiction <br />and is no longer a part of the Meadows No. 1 f4ine permit area. <br />Enforcement actions since the 1988 permit renewal are: <br />Notice of Violation No. C-89-006 was issued on i-larch 20, 1989 for failure <br />to maintain Sediment Pond No. 4 to prevent leakage. The IJOV was abated <br />on June 1, 1985. The penalty assessment of >i25D.DD was paid. <br />-1- <br />
