-5- <br />SUMMARY OF THE REVIEW PROCESS <br />The Chimney Rock Coal Mine, located 22 miles southwest of Pagosa Springs, <br />Archuleta County, Colorado, is currently operating under Permit No. C-023-81, <br />issued by the Colorado Mined Land Reclamation Board on January 7, 1983. <br />On June 21, 1983, Chimney Rock Coal submitted an application for Permit <br />Revision No. 1. The purpose of this revision was to allow mining of <br />approximately 47.5 acres of federal coal in Section 30, T34N, R4W, N.W.P.M., <br />Archuleta County, Colorado. This coal is located adjacent to the property <br />which Chimney Rock Coal was currently mining. <br />The Division prepared and issued a proposed decision package on <br />December 13, 1983. The Permit Revision No. 1 application was approved on <br />January 16, 1984. <br />This findings document does not supercede or replace the existing Permit <br />Revision No. 1 Findings document. All plans, stipulations commitments, etc. <br />discussed in that document remain in full force. Findings included in this <br />document deal only with the Revision No. 2 application. <br />On February 1, 1984, Chimney Rock Coal initially submitted Permit Revision No. <br />2 for the Deep Creek area. The submittal was found incomplete on February 14, <br />1985. Chimney Rock submitted additional information and Permit Revision No. 2 <br />was found complete on March 6, 1984. On April 13, 1984 Chimney Rock Coal <br />withdrew Permit Revision No. 2. <br />Chimney Rock Coal resubmitted Permit Revision No. 2 on October 2, 1984. The <br />resubmitted revision was found complete on October 12, 1984. A preliminary <br />adequacy review was sent to the applicant on December 14, 1984, outlining <br />outstanding concerns with the application. On February 8, February 25, and <br />March 4, 1985, the applicant submitted responses to the questions in the <br />preliminary adequacy review. On March 27, 1985 representatives of the <br />applicant and their consultants met with the Division and Office of Surface <br />Mining personnel to discuss the responses. On April i2, and 18, 1985, the <br />applicant submitted additional information and responses to the adequacy <br />review. Additional meetings on April 1 and 9, 1985, were held with the <br />applicants consultant. <br />Since that time the Division has been reviewing the application responses and <br />preparing the following findings. <br />
