-3- <br />PROPOSED DECISION <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, an application for a permit revision to conduct surface and <br />auger coal mining at the Chimney Rock Coal Mine. This mine is located on both <br />private and federal lands and coal within Archuleta County, Colorado. The <br />legal description of the lands included in the Permit Revision No. 2 area is: <br />The S 1/2 SW 1/4 NW 1/4 Sec. 29; the NW 1/4 SW 1/4 Sec. 29; the E 3/4 SW <br />1/4 SW 1/4 Sec. 29; (Forest Service Special Use Area), and a portion of <br />NE 1/4 SE 1/4 Sec 30; all in T34N, R4W of the N.M.P.M. <br />The area of federal coal is within the NW 1/4 SW 1/4 Sec 29, T34N, R4W, <br />N.M.P.M. <br />The Forest Service Special Use area is within the E 3/4 SW 1/4 SW 1/4, <br />Sec. 29, T34N. R4W, N.M.P.M. <br />This decision is based on a finding that the existing and proposed operations <br />comply with all requirements of the Colorado State Program as found in the <br />Colorado Surface Coal Mining Reclamation Act, C.R.S. as amended, 34-33-101 et <br />sec., and the Regulations promulgated pursuant to the Act. <br />If no requests for a formal hearing are made within 30 days of the issuance of <br />this proposed decision, then this decision becomes final and upon acceptance <br />of acceptable surety by the Division, the permit application and stipulations <br />contained herein will become a binding part of the permit. <br />
