<br />DRAFT <br />lJ <br />COLORADO NATURAL AREAS PROGRAM <br />DEPARTMENT OF NATURAL RESOURCES <br />STATE OF COLORADO <br />MOUNT CALLAHAN NATURAL AREA <br />ARTICLES OF DESIGNATION <br />These Articles of Designation, made this of 1987, by and between <br />the State of Colorado, acting by and through the Department of Natural <br />Resources, for the use and benefit of the Division of Parks and Outdoor <br />Recreation, Colorado Natural Areas Program, 1313 Sherman Street, Room 718, <br />Denver, Colorado 60203, hereinafter the Department, and the Occidental 011 <br />Shale Incorporated, P.O. Box 2687, Grand Junction, Colorado, 81502, <br />hereinafter the Owner. <br />WHEREAS the Owner owns and manages certain lands totaling 360 acres as <br />described in Exhibit A, attached hereto and incorporated herein by reference, <br />and known as the Mount Callahan Natural Area situated in the County of <br />Garfield, State of Colorado, hereinafter the Property; and <br />WHEREAS, the Owner has declared that the Property be preserved and protected <br />as a biological preserve and natural area; <br />WHEREAS, the Department is authorized to conduct and administer the provisions <br />of the Colorado Natural Areas Act as set forth at C.R.S. 36-10-101, et sec.); <br />and <br />WHEREAS, the Natural Areas Act established a statewide Colorado Natural Areas <br />Program, hereinafter the Program, to provide a means by which specific <br />examples of Colorado's natural features and ecological phenomena can be <br />identified, evaluated, and protected through a statewide system of designated <br />natural areas; and <br />WHEREAS, the Act established a Natural Areas Council, hereinafter the Council, <br />which advises the Department on the administration of the Program and which <br />recommends the designation of Colorado Natural Areas by the Department; and <br />WHEREAS, the Department has determined, pursuant to its criteria, that the <br />Property is a natural area and that it would be desirable to include the <br />Property within the Colorado Natural Areas System as a designated Colorado <br />Natural Area; and <br />
