I appreciate your <br />interest and support in designating Mt. Callahan as a Colorado Natural <br />Area. <br />I am attaching revised Articles of Designation for Mt. Callahan <br />which incorporate your suggestions for language in Section 4 (page 3). I <br />did not include the language you suggested far Section 3 0 (page 3) <br />because Articles of Designation cannot dictate land use activities <br />occurring outside the designated natural area nor can Articles of <br />Designation affect mining activities mandated by state or federal law. <br />The Department of Natural Resources recognizes and encourages the <br />research potential of the Logan Wash facility. However, cessation of <br />mining activity is subject to the provisions of CRS 34-32-103(6) of the <br />Mined Land Reclamation Board statutes. The language is very specific as <br />to the actions required by a company when cessation of mining occurs. <br />Thus, Oxy's actions and requirements under the company's current <br />reclamation permit must be addressed directly to the Mined Land <br />Reclamation Board. <br />Thank you again for your cooperation. The willingness of private <br />land owners to protect significant natural features in Colorado for <br />research and educational purposes is gratifying.
