Reclamation cost liability associated with backfilling the requested portions <br />of Pit D, Pit H, Pit F, and Pit A would have been $7,908,600.00, based upon a cost per lineal foot <br />measurement of the pit dimensions. The operator did not request a reduction in the bond amount. Bond <br />release pazcels included in the SL-OS Phase I bond release application have not been evaluated for Phase <br />II or Phase III reclamation success criteria. The reclamation cost estimate was last evaluated and <br />updated in May 2003 during RN04/PROS. Backfill and grading costs were calculated in May 2003 on <br />the existing open pits and un-graded disturbances at that point in time. Pazcels in the SL-OS application <br />that had been backfilled by May 2003 did not have backfill and grading tasks assigned to them in the <br />revised reclamation cost estimate; however, the Division ensured that TMI maintained reclamation <br />liability on those parcels until SL-OS was submitted and approved. The Division estimates the cost to <br />complete remaining reclamation work at the site to be $24,844,491.00. The Division currently holds a <br />performance bond of $25,900,000.00. TMI did not request that any monies be returned for SL-OS. The <br />remaining $25,900,000.00 is sufficient to assure completion of the remaining reclamation work at the <br />site if the work had to be performed by the Division. Liability release for the requested pazcels will not <br />affect the $24,844,491.00 value estimated for costs for remaining reclamation. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision may <br />request a formal public hearing before the Mined Land Reclamation Boazd in accordance with Rule <br />3.03.2(6}. Public notice of this proposed decision will be published twice in the Craig Daily Press for <br />two weeks as soon as possible.
