Based upon a review of the mine permit, the applicant's bond release application, and site inspections, <br />the Division finds that TMI has backfilled, regraded and re-established permanent drainages in <br />accordance with the approved reclamation plan. <br />IV. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve Trapper Mining Company's request <br />for a partial Phase I bond release for the Trapper Mine. This proposed decision will release the <br />applicant from reclamation liability for Phase I bond release criteria on bond release blocks; A-B-96 <br />through A-B-OI, a portion of A-B-95, a portion of A-C-95, A-C-94, A-C-87A, F-AB-02, F-AB-OI, F- <br />AB-00, F-AB-99, H-B-98, H-B-96, H-C-98, D-AB-97 through D-AB-02, D-A-96, D-B-96, and D-C- <br />99, totaling 823.9 acres. <br />PHASEI <br />In the four preceding bond releases, SL-O1, SL-02, SL-03, SL-04 the Division released the liability on <br />the bond release blocks but did not return any monies to the operator. The previous bond releases <br />applied to the backfilling, regrading, suspended solids demonstration and vegetation establishment of <br />2482.7 acres of lands associated with the Ashmore, Browning/Colt, Derringer, and Enfield pits. The <br />operator did not request a reduction in the bond amount. <br />The Trapper Mine is an active mine with five active pits and two pits that have been approved to receive <br />flyash.
