For questions regarding Air Emissions permitting, please contact: <br />Colorado Department of Health <br />Air Quality Control Division <br />(303) 692-3100 <br />8. The Irvin Pines mine site bond release process could conceivably be influenced by future <br />Office of Surface Mining (OSM) actions. However, we ~wr-ot predict the likelihood or <br />nature of OSM action relative to the Twin Pines site. <br />9. DMG inspections will continue throughout reclamation operations and the subsequent <br />Lability period, and ongoing compliance is required. <br />10. Please be advised that if a forfeiture of the bond occurs, and if the available money is not <br />adequate to allow total reclamation of the mine and loadout sites, then it is likely that the <br />DMG and the Colorado Attorney General's Office would pursue the company and/or any <br />liable individuals for additional monies. <br />11. Please also be advised that a permit revocation bond forfeiture would effectively prevent the <br />company and any related entities or individuals from obtaining a coal mining permit in <br />Colorado or in any other state. <br />12. Permit revocation would undoubtedly involve enforcement procedures which include civil <br />penalties and, in the most extreme circumstances, individual criminal liabilities. <br />We are hopeful that Twin Pines can continue to reclaim the mine and loadout sites to avoid <br />revocation and enforcement procedures. We are committed to assist and advise Twin Pines to <br />the extent that we can under the applicable Colorado laws and regulations.
