Your willingness to <br />cooperate is appreciated. Following our meeting, I consulted with Susan McCannon (Coal <br />Program Supervisor) about your questions, and this letter is intended to answer your questions as <br />I understand them. <br />1. We may be able to grant a reduction in the groundwater monitoring plan for the Twin Pines <br />Mine. If you choose to pursue this issue, it will be necessary to submit a technical revision <br />application which outlines the reasoning behind the monitoring reduction request. <br />2. We are reviewing the Technical Revision No. 7 application at this time, and we will <br />forward any questions or concerns by Wednesday or Thursday of next week. <br />3. There is no flexibility in the required ten-year liability timeframe for coal mine reclamation. <br />The ten-year liability period initiates after the last year of augmented seeding: fertilizing, <br />irrigation or other work. <br />4. The personal injury and property damage insurance must be maintained for the life of the <br />permit, which includes reclamation and liability periods. <br />5. The operator is required to maintain the legal right to enter any mining site at which <br />operations, reclamation or ongoing maintenance are required. <br />6.
