<br />IX. INSPECTION AND NON-COMPLIANCE <br />It is agreed that the operation will be open on request for inspection <br />by the Pikes Peak District Ranger or his appointed representatives and <br />that at least annual inspections will he made during the course of the <br />operation and a final inspection will be made on cessation of the operation <br />to insure compliance with the provisions of. the Operating Plan and, <br />where applicable, to determine if bond requirements have been satisfied. <br />X. MAINfEDTANCE A[~ID PUBLIC SAFETY <br />It is herein agreed that during all operations, Castle Concrete <br />Company shall maintain its structures, ewigrent, and other facilities <br />in a safe, neat and ~+orkmenlike manner. Hazardous sites or conditions <br />resulting from the operations shall be marked by signs, fenced or otherwrise <br />identified, to protect the public. <br />XI. CESSATION OF OPERATIONS <br />Unless otherwise authorized by the District Fanger, it is agreed to <br />remove within one year rn cessation of operations all strictures, equiprent, <br />and other facilities and to clean up th.e site of operations. <br />Where operaticns have cc-used tempcu~arily, it is agreed to file a <br />statement with the District Ranger, whidi includes: <br />1. Verification of intent to maintain the strictures, ewipment <br />and other facilities. <br />2. Advise of the expected date of resuming operations. <br />3. Provide an estimate of the extended duration of operations. <br />It is further agreed that, (a) a statement will be filed each year <br />by Castle Concrete Company in the event operations are not reactivated, <br />and, (b) Castle Concrete Con>pany will maintain the operating site, <br />structures, ewipment, and other facilities in a neat and safe condition <br />during non-operating periods. <br />XII. PRE17E3dPICN AND CCY4TROL OF FIRE <br />Castle Concrete ~nY agrees to amply with all applicable Federal <br />and State fire laws and regulations and shall take all necessary measures <br />to prevent and suppress fires on the area of operatirns and shall require <br />its employees, contractors, and subcontractors to do likewise. <br />XIII. SUPPLEMENTAL PLANS <br />It is agreed that if it becchies necessary to change the plan of <br />operatirns proposed in this Operation Plan, or the State of ~lorado <br />Page 5 of 6 <br />
