70,000 tons of clean coal per month. Up until November 1994, production was limited to the Roadside South <br />Portal, but at that time the North Portal was reactivated, and coal was produced from both portals until early <br />1997, when all coal production was shifted to the North Portal. Due primarily to coal quality problems, mining <br />ceased on December 2, 1999. By letter ofDecember 13, 1999, the operatornotified the Division that cessation <br />of operations would extend beyond 30 days. A subsequent letter received by [he Division on Mazch 14, 2000, <br />provided official notice that the cessation of operations was permanent, pursuant to Rule 4.30. <br />The original permit has been granted renewal for successive five year permit terms twice, the most recent <br />renewal decision was finalized Mazch 20, 2000, for a permit term extending through January 3, 2003. Three <br />stipulations (2, 22, and 23) were attached to the 2000 permit renewal (RN-03), and current status of those <br />stipulations and subsequent stipulations is summarized below. Several technical revisions (TR's) and minor <br />revisions (MR'S), one Succession of Operators (SO), two bond adjustment/surety increases (SI's), and two <br />Phase 1 bond release applications (SL's) were submitted and processed since the most recent mid-term permit <br />review (August 2000). These permitting actions aze also summarized below. <br />Status of Previous Stipulations <br />Three stipulations were attached to the 2000 RN-03 renewal permit and proposed decision (2, 22, and 23) <br />Stipulation No. 2 required submittal of an annual mine inflow report and outlines the information to be <br />included in the report. The stipulation references an annual mine water inflow and water consumption report, <br />including a seep location map. Because mining operations have ceased and the portals have been sealed, Urere <br />is no further operational water consumption, and inflow mapping is no longer possible. Remaining water <br />balance information, including minewater dischazge quantification, is addressed within the Annual Hydrology <br />Report (AHR): The informational requirements and submittal deadline for the AHR is adequately addressed in <br />Tab Section 18 of the approved permit application. For these reasons, Stipulation No. 2 is no longer <br />requrred, and is hereby terminated. <br />SBpulaHon No. 22 requires specific documentation to be provided prior to initiation of mining within the <br />subsidence angle of draw beneath the 345 KV Rifle-San Juan Powerline, within the South Portals mining azea. <br />Mining operations have ceased, and the portals have been sealed. As such, it if likely that the concerns <br />addressed by the stipulation will not be realized. The stipulation is retained as a precautionary measure, in the <br />unlikely event that operations would re-initiate in the futwe. <br />Stipulation No. 23 pertained to resolution of violations issued by the states of Virginia and West Virginia to <br />Quaker Coat Company, the parent company of Powderhom Coal Company, former operator/permittee of the <br />Roadside North and South Portals Mine. Powderhorn Coal Company is no longer associated with the <br />operation, and the stipulation does not pertain the current operator/permittee, Snowcap Coal Company, Inc. <br />For this reason, Stipulation No. 23 is no longer required, and is hereby terminated. <br />Permitting Actions Processed Since August 2000 Mid-term Permit Review <br />Technical Revisions <br />TR-32 proposed approval decision was issued November 27, 2000. The revision was submitted in response to <br />a DMG revision order, and it addressed various reclamation plan changes that were necessitated by eazlier than <br />4 <br />
