SHELTON Director
February 16, 1983
Jim Points, Manager
Charles R. Ponchak, Chief Geologist
Camp Bird Colorado, Inc.
Ouray, Colorado 81427
Dear Messrs Points anti Ponchak:
I have received a copy of your letter to Senator Noble dated February 11,
1982, regarding communications between this Division and Gila Mining.
In retrospect, it appears that our communication with Gila Mining (copy
attached} was premature. The news article (copy attached) from the
Daily Sentenial of Grand Junction, November 5, 1982, clearly indicated
that Gila Mining had purchased, and was the owner of the Camp Bird
mining property. It was on this basis that we contacted Gila 1•tining
and informed them of requirements related to our Statute.
Apparently, negotiations at that time were still in progress and thus, the
newspaper article was incorrect. As a result of this situation, I have
instituted a policy that we will always communicate only with the permitted
operator of the site when a similar situation arises.
I apologize if this effort to inform a mining company of statutory requirements
has caused difficulty, but I can assure you that our letter to Gila Mining
was not intended to damage your ability to negotiate a sale, but was rather
far informational and helpful purposes only. If you have any further questions
regarding the situation, please do not hesitate to contact me.
Sincerely,
David C.
