Section III -Status of Stipulations <br />At the time of the permit renewal, nine stipulations were placed on the pennit. To date, PWCC <br />and the Division have resolved eight stipulations, Listed below is each of the nine stipulations and <br />their current status. <br />Stipulation No. 5 <br />Peabody Coal Company will submit an annual hydrologic report to the Division following <br />each water year (October 1 to September 30). This report shall include all of the reduced <br />and tabulated surface and ground water data collected during the year. An interpretation <br />of the data and a discussion of possible trends should be included in the report. This report <br />shall be submitted to the Division no later than February 28 of the following year. <br />Status: Ongoing, being complied with <br />Stimulation No. 8 <br />The following aspects of the Seneca II-W revegetation plan will be implemented or modified <br />as stated below: <br />A. The use of alfalfa and pubescent wheatgrass will not be allowed until such time as <br />the applicant demonstrates through site-specific data (based on similar seeding rates <br />and methods) that these species are both desirable and necessary. <br />B. The applicant will submit and have approved all supplemental shrub and fort <br />components of the seed mixes (species and rates). <br />C. Within ninety (90) days of permit issuance, the permittee shall develop and submit <br />for Division approval a revegetation monitoring plan for reclaimed areas. The plan <br />shall address methods of sampling and sampling intensity for years 2, 4, and 7 of a <br />revegetated area for vegetative cover and woody plant density. <br />Status: 8A -Resolved, 6/03/91 <br />8B -Resolved, 6103191 <br />8C -Resolved, 7/15/86 <br />Stipulation No. 4 <br />Peabody Coal Company must demonstrate that blasting operations within 500 feet of the oil <br />well will not damage the integrity of the well casing and detail the safety precautions which <br />will be utilized to ensure that vented gas is not ignited. This demonstration must be <br />submitted to the Division and approved prior to any blasting on site. <br />Status: Resolved 6/23/89 <br />Seneca 7I-W Mine Page 5 <br />
