-7- <br />Stipulation No. 8 <br />PRIOR TO UTILIZATION OF THE UNDERGROUND DEVELOPMENT WASTE DISPOSAL AREA, <br />TWIN PINES COAL COMPANY, INC. MUST PROVIDE MASS BALANCE CALCULATIONS <br />WHICH DEMONSTRATE THE MOVEMENT OF MATERIAL TO COVER THE WASTE DISPOSAL <br />AREA WITH TWO FEET OF NON-TOXIC, NON-COMBUSTIBLE SUITABLE PLANT GROWTH <br />MEDIUM IN ACCORDANCE WITH RULE 4.11.4.(2). AS A CONSEQUENCE, THE <br />POST-MINING TOPOGRAPHIC MAP MUST ALSO BE REVISED TO REFLECT THESE CHANGES <br />PRIOR TO UTILIZATION OF THE WASTE DISPOSAL AREA. <br />Status - In Compliance, Resolved <br />This stipulation has been adequately addressed and no further responses are <br />required. <br />Stipulation No. 9 <br />PRIOR TO PRODUCING COAL FROM THE TWIN <br />COMPANY MUST RECEIVE APPROVAL FROM THE <br />FOR THE TWIN PINES NO. 1 PORTAL AREA. <br />WITH THE REQUIREMENTS OF RULE 2.05.4. <br />DAYS OF PERMIT ISSUANCE. <br />PINES N0. 2 MINE, TWIN PINES COAL <br />DIVISION FOR THE RECLAMATION PLAN <br />THE RECLAMATION PLAN MUST COMPLY <br />AND MUST BE SUBMITTED WITHIN 120 <br />Status - In Compliance, Resolved <br />The Twin Pines Mine has submitted a reclamation plan for the No. 1 portal area <br />and this plan has been approved by the Division. <br />III. Bonding <br />Bonding calculations are presented on pages 72 and 89 of the permit. The <br />site is currently bonded for E54,130.00 in the form of a Certificate of <br />Deposit. The bond calculations follow the generalized or intuitive <br />nature of the reclamation plan and although they include all necessary <br />items the assumptions are not clearly stated. The Division has <br />recalculated the reclamation costs utilizing standard unit costs from the <br />CAT Handbook, Means Construction Cost Data, and the CRG Machinery Rate <br />Guide. The total calculated reclamation cost was E67;581.00. The cost <br />worksheets and tables from the Division's calculations are enclosed. <br />These costs may be summarized as follows: <br />Although several of the line items in this estimate are different, the <br />total direct costs are similar. The mayor difference in the estimates is <br />the inclusion of indirect costs in the Division calculations. These are <br />costs which would be incurred by the Division in contracting site <br />reclamation to a third party. <br />- 7 - <br />
