<br />The following terms and conditions are extended by an amount of time equal to the duration of <br />the suspension: <br />1. The lease terms and lease readjustment dates; and <br />2. MLA section 2(a)(2)(A) IO-yeaz holding period. <br />The suspension is subject to the following stipulations: <br />1. Access to the McClane Canyon Mine shall be maintained for the duration of the suspension. <br />2. The State Director, Colorado, shall be notified immediately upon the cessation of the <br />condition, situation, or event which constituted the basis for the suspension. <br />3. The State Director, Colorado, shall be notified by the lessee immediately upon <br />recommencement of beneficial use of [he LMU/]eases. <br />4. The lessee shall certify to the State Director, Colorado, prior to the end of each successive <br />l2-month period following the effective date of the suspension, that the conditions justifying the <br />suspension continue. The annual certification shall also contain documentation of the lessee's <br />efforts to enhance the mazketability of the coal, such as letters of intent, contractual agreements, <br />or negotiations towazd contruction of a rail spur. Lacking such annual documentation, the BLM <br />reserves the right to determine whether competing development interest in the LMU reserves <br />may be cause for cancellation of the suspension. <br />5. The lessee shall submit a permit revision application to Colorado Mined Land Reclamation <br />Division and a resource recovery and protection plan modification to BLM that reflects any <br />changes in the mining and reclamation plan caused by the suspension. <br />6. This suspension may be extended upon a showing that the conditions warranting the <br />suspension still exist. An extension will be considered if application is made before expiration of <br />the five-yeaz term. <br />7. This suspension shall terminate upon: <br />a. The date beneficial use of the LMU/leases recommences; or <br />b. The date the situation determined to be in the interest of conservation ceases; or <br />c. The date that annual recertification of continuing conditions is due but has not been filed by <br />the lessee; or <br />d. June 30, 2002, whichever occurs first. <br />
