Future <br />leasing would create additional and possibly more extensive surface disturbance. Due to Mine <br />Safety and Health Administration regulations, future development would most likely be <br />through new portal sites, resulting in coal lost in barriers around the current portal sites. The <br />entire LMU reserves can be produced from the McClave Canyon Mine or a combination of <br />McCLute and Munger. Other nearby potential portal sites are located in steep, narrow canyons <br />and show evidence of extensive bum at the outcrop or landslides, or would not provide access <br />to faulted portions of the reserves. <br />In order to ensure Mardmum Economic Recovery, and in the interest of conservation of <br />the leased mineral resource and other natural rrsourrxs on and adjacent to the LMU, the <br />requested suspension of operations and production is hereby granted for a period of five <br />years, effective June 30, 1997, c~!tgert to annum n,fiFiratinn as required by Stipulation <br />3 of this decision. <br />The following LMU/lease terms and conditions are suspended during the effective term of the <br />suspension: <br />1. Payment of rental effective June 30, 1997; <br />2. Beneficial use of the LMU/leases effective June 30, 1997; <br />3. The diligent development commercial quantities requirement; <br />4. Continued operation production requirement; and <br />5. MLA section 2(a)(2)(A) commercial quantities requirement. <br />The following terms and conditions are NOT suspended: <br />1. Royalty payments for coal mined and removed from the LMU/leases prior to the effective <br />date of this suspension but sold or otherwise disposed of during the suspension; <br />2. Royalty payments for coal mined for safety purposes during the suspension; <br />3. Reclamation requirements; <br />4. Casual use as defined at 43 CFR 3400.0-5(e); and <br />5. Public and mine personnel health and safety requirements. <br />
