Information on page 2.03-9 indicates that there aze no pending <br />purchases of record of any surface or mineral estate under a real estate contract. Information on <br />page 2.03-7 is not so exclusive. <br />Please revise the PAP accordingly to indicate any (or none) purchase of record under a real <br />estate contract. <br />Item 4. Rule 2.03.4(7). Contiguous surface landowners are identified on Map 1, and the names <br />and addresses of contiguous surface owners are found on page 2.03-9 of the PAP. Minor <br />deficiencies are that the addresses of the Bureau of Land Management and the Colowyo Coal <br />Company L.P. aze not provided here, and the name and address of the Northern Coal Company <br />does not appear in the list of Contiguous Surface Owners (on page 2.03-9). Northern Coal <br />Company lands are located at the northern extremities of the water line to the distant (from the <br />main permit azea) Wilson Pond. Contiguous subsurface landowners (coal) are identified on Map <br />2, and the names and address of contiguous subsurface landowners are listed on pages 2.03-9 and <br />2.03-10 of the PAP. The address of the Bureau of Land Management is not provided, and the <br />Northern Coal Company is not included in the list. Annotations on page 2.03-9 aze unexplained. <br />Please add the addresses of the Bureau of Land Management and the Colowyo Coal <br />Company L.P., and the name and address of the Northern Coal Company to the list of <br />Contiguous Surface Owners. Please add the address of the Bureau of Land Management in <br />the list of contiguous subsurface owners, and the name and address of the Northern Coal <br />Company as a contiguous subsurface owner. Please clarify the meaning (or remove) the "c, <br />o, and g" annotations on pages 2.03-9 and 2.03-10 (Rev 42). <br />Item 5. Rule 2.03.4(8). The PAP is in compliance with this rule. The name of the mine is the <br />Colowyo Coal Mine, and the MSHA number is 0502962 (PAP, Page 2.03-10, Section 2.03.5). <br />Item 6. Rule 2.03.4(9). The PAP is in compliance with this rule. Colowyo holds no option to <br />purchase lands contiguous to the permit boundary (PAP, Section 2.03.5, Page 2.03-10). <br />Item 7. Rule 2.03.6(1). The requirements of this rule aze many and varied, and address <br />documents of complex wording. The legal description of the permit area is presented in an <br />example of a proposed newspaper advertisement (page 2.03-15). However, the description falls <br />short of a "complete and detailed legal description of the proposed permit boundary" (italics <br />added). Portions of the description aze of areas rather than the boundary. With regard to pipeline <br />right-of-way in Sections 13, 23 and 24 T4N R93W, the description is close to a boundary <br />description. Such narrow rights-of-way boundaries are frequently described as that azea bound by <br />lines on both sides of, parallel to, and at some distance on either side of (25'foot) from a line <br />beginning at (a specific location), then (bearing) for a distance, etc for the length of the pipeline <br />
