C-S1-019 2000 Midterm Review <br />November 20. 2000 <br />In addition, there was one bond release (1997 Phase I Bond Release, SL-02) since the Permit <br />renewal of November 5, 1997. The date of SL-02 decision was April 27, 1998. This bond release <br />was for release of liability for accomplished reclamation work. There was no reduction in the <br />amount of bond held. <br />A reduction in the permittee's liability cost estimate from $19,670,521 to $15,670,52 l was <br />approved under TR 43. The amount of reclamation bond held was reduced from $20,016,723 to <br />$16,016,723. The permittee's liability cost estimate for reclamation work was raised under TR 49 <br />from $15,670,521 to $15,702,397. See Section VI below for a summary of bond information. <br />Section III -Status of Stipulations <br />There aze no current stipulations on the Pemut. A Stipulation 1 to MR 48 was complied with <br />under MR 49. There are a number of stipulations that were incorporated into the text of the PAP <br />yet retain their identity (by title) therein. However, these sections of the text are considered <br />integral to the text of the permit, and are not carried as (separate) stipulations to the Permit. <br />Section N -Permit Variances <br />There are no variances to the permit under Rules 2.06.2(10), 2.06.3(4), 2.06.5(3), and 2.06.7(5). <br />Section V -Decision to Reouire Revisions or Additional Information <br />Compliance with the following rules has been identified for review during this midterm review. <br />Comments on compliance with each rule aze identified, followed by a request(s) of Colowyo (in <br />bold type) to modify the PAP by an appropriate technical revision. <br />Item 1. Rule 2.03.4(6)(a). Information with regazd to this Rule is located on pages 2.03-6 and <br />2.03-9, on Maps 1 and 2, and in Exhibit 1 of the PAP. With the exception of addresses, the <br />information provided on this page and Map 1 is complete with regazd to surface ownership. <br />Some detailed information appears to have been deleted for coal ownerships. The Rule requires <br />addresses as well as names. The address of the Colowyo Coal Company L.P. is provided on page <br />2.03-6. The address of the Bureau of Land Management and the State of Colorado aze not <br />provided in these sections of the PAP. In the northern reaches of the permit azea (see Map 2), <br />azeas aze annotated with the coal ownership note "Numerous xxx (yy)", where xxx is a number <br />and yy is a number. Apparently, they referred to a tab of Exhibit 1, and the xxx referred to a <br />pazagraph or legend for a description of landowners and their addresses. No such tabs or <br />descriptive pazagraphs were located during this review. <br />Please revise (restore) the coal ownership information (names and addresses of the legal or <br />equitable owner of record of the coal to be mined) to meet the identity and address <br />requirements of this Rule. Please include an explanation with references (or cross- <br />references) to information found at different sections of the PAP. Note that Rule 2.10.3(1) <br />requires permits to include a map that shows the names of owners of record of subsurface <br />lands (i.e., coal) in and contiguous to the permit area. <br />
