C-81-019 2000 Midterm Review <br />November 20, 2000 <br />approximate recharge capacity of the permit azea and adjacent area is not required as no adverse <br />impact to recharge capacity is anticipated [Rule 2.05.6(3)(b)(vii)]. No additional information is <br />required to assess the probable hydrologic impact [Rule 2.05.6(3)(b)(viii)]. However, the <br />Division believes there may be a potential for eventual development of spoil springs, especially <br />at the Streeter and West Pit fills. To date, there has been no spoil spring flow identified at either <br />fill. <br />Please reword parts of page 2.05-74 and 4.05-2 to recognize, and make reference to, in the <br />PAP, those exceptions to surface water from disturbed areas reporting to sedimentation <br />ponds (Small Area Exemptions), including associated demonstrations. Such areas are those <br />considered in IVIRs 15 and 18, the administration building area, the security building area, <br />the East Taylor Pumping pond and station, waterline trace, scoria pit, and topsoil storage <br />piles (and perhaps others). <br />The Division suggests a rewrite on page 4.05-10 to consolidate the dispersed description of <br />the current approved monitoring activities into a specific, cohesive description of the <br />monitoring program [Rules 2.05.6(3)(b)(iv) and 4.05.13]. The text currently describes the <br />evolution of the program, and retention of this information (clearly indicated as historical) <br />may be desirable to indicate the progressive development of the current program. Please <br />include in the definition the purpose of each monitoring station, as it relates to monitoring <br />of (or demonstration of lack of) Probable Hydrologic Consequences of the mining <br />operations. <br />Item 43. Rule 2.05.6(4)(a). The PAP is in compliance with this rule. There are no public parks or <br />places listed on the National Register of Historic Places within the permit or adjacent areas (PAP <br />page 2.05-75). <br />Item 44. Rule 2.05.6(5). Initial open-pit mining (circa 1977, 1978, and somewhat later) was <br />located over and adjacent to abandoned underground mines. Current mining activity is located at <br />distances well over 500 feet from these underground mine workings. <br />Item 45. Rule 2.10.2. Map 23 is the mine plan. Current and future phases are shown thereon. <br />Operations existing prior to August 3, 1977, and after August 3, 197 and prior to May 3, 1978, <br />are shown on Map 22. Areas of mining existing after May 3, 1978 and prior to December 15, <br />1980 (see July 1999 Code of Federal Regulations Chapter VII Part 906.10), are not specifically <br />shown (combined into one classification of May 3, 1978 through August 22, 1990) on Map 22. <br />Phases are not broken out (shown as combined) between May 3, 1978 through August 22, 1990 <br />(Map 22). Phases between August 22, 1990 and 1998 do not appear on either map. <br />Please add to Map 22 a phase for the period blay 3, 1978 and prior to December 15, 1980; <br />phases during the period December 15, 1980 and August 22, 1990; and phases during <br />which surface coal mining operations were conducted between August 22, 1990 and 1998. <br />Item 46. Rule 2.10.3(1). Map 1 is the surface ownership map. Present owners of record are <br />shown thereon [Rule 2.10.3(1)(a}]. The legend does not indicate the boundaries of land upon <br />which the applicant has the legal right to enter [Rule 2.10.3(l)(b)].
