King Pline, La Plata County, Colorado I. Recommendation I recommend termination of Federal permit CO-0043, issued on June 30, 1982, for the National King Coal, Inc. King mine. !7y recommendation -- _ is based on the existence of the Colorado cooperative agreement which provides for the delegation to the Colorado i4ined Land Reclametion Division (NERD) of the permitting responsibilities for operations on Federal lands pursusnt to Section 523 of the Surface tdining Control an3 Reclamation Act (SMCRA); the issuance of the Colorado State oermit C-31-035 in accordance with the Colorado State program and cooperative agreement; incorporation of all necessary Federal permit conditions in the State permit; and the epproved miring plen for Federal leases, C-29125 and P-058300. Attached to this memorandum are the eppliceble standard conditions of approval of the King mine airing plan approved by the P.ssistant Secretary on ,lay 20, 1932, for Federal leases C-2°125 an3 P-058300. These conditions xere previously incorporated in the Federal permit. Notwithstanding the te~i_nation of the Federal permit, these coalitions will remaia in full force end effect. Colorado ^ff,RD has re-riewed the pewit epplicetion package (PP°) for the Y.ing minx under the Colorado State program and cooperative agreement (30 CFR 900.30) end has issue3 Colorado permit C-81-035 authorizing surface coal mining and reciemation operations oa Federel and non-Federal lands in the permit area pursuant to the State program and cooperative agreement. A copy of the bond in the amount of $100,000.00, psyable to the Unite3 States aa3 the State of Colorado, is on file with OS~iRE.
