Box 2905 ~~c~h91FJ~p L.aT~tD <br />Durango, Colorado 81302 Mf+1'IDIV DIVIc;IpN <br />Dear Mr. Helmin: <br />The Office of Surface Mining Reclamation and Enforcement (OSPIRE) has <br />terminated, effective immediately, Federal permit CO-0043, issued an June 30, <br />1982, for National King Coal, Inc.'s King mine. The Federal permii was <br />terminated in accordance with OSATRE's Directive on the Termination of Federal <br />Permits 'oecause the State has a cooperative agreement that delegates the <br />permitting responsibilities on Federal lands to the State, and Colorado i4ined <br />Land Reclamation Division (MLRD) has issue3 State permit C-81-035 for the icing <br />mine in accordance with the Colorado State program and cooperative agreement. <br />I have enclosed the memorandum terminating the Federal permit. Attached to <br />the memorsndum are the applicable standard conditions of approval of the Y,ing <br />mine mining plan approved by the Assistant Secretary on i•lay 20, 1932, for <br />Federal leases C-29125 and P-058300. These conditions were previously <br />incorporated in the Federal permit. Notwithstanding the termination of the <br />Federal permit, these conditions remain in full force and effect. <br />Colorado MLRD is now the regulato*_y authority for surface coal mining and <br />reclamation operations on Federal lsnds at the icing nine under the Colorado <br />State permit 0-91-G35, the Colorado State program, end the cooperative <br />agreement.
