<br />PROPOSED DECISION <br />The Colorado Mined Land Reclamation Division proposes to approve, with one <br />stipulation, an application for a permit revision to conduct coal mining by <br />Trapper Mining, Inc. for the Trapper Mine. This approval allows for continued <br />mining in the previously approved areas. It also approves modifications in <br />the approved permit boundary and for topsoil stripping and overburden <br />blasting, and other preliminary development work in the Colt and Browning Pit <br />areas. <br />4 more detailed description of these changes is provided in this document. <br />The proposed approval applies to the following area: Portions of Sections 5 <br />and 6 in TSN, R90W; portions of Sections 1; 4, and 5, and all of Sections 2 <br />and 3 in T5N, R91W; portions of Sections 30 and 32, and all of Sections 31 in <br />T6N, R90W; and portions of Sections 21, 25, 26, 27, 28, 29 and 32 and all of <br />Sections 33, 34, 35, and 36 in T6N, R91W. <br />The Division has made the required findings for approval of all surface coal <br />mining and reclamation operations as identified and described in the permit <br />revision application, subject to the stipulations and conditions stated in the <br />findings document and this proposed decision. <br />This approval is based on a finding that the proposed operation as identified <br />and described in the permit revision application will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, C.R.S. 1973, <br />as amended, 34-33-101 et seq., and the Regulations promulgated pursuant to the <br />.Act. ~ - <br />Stipulation No. 1 of the original findings document required Trapper Mining, <br />Inc. to devise acceptable revegetation success standards for cover and <br />productivity. These standards have been submitted, therefore this stipulation <br />has been satisfied and is no longer required. <br />Stipulation No. 3 concerning the verification of swell factors has also been <br />satisfied. At this time the only stipulation still in effect in No. 2 which <br />reads as follows: <br />STIPULATION N0. 2 <br />THE DIVISION DIRECTS THE PERMITTEE TO MONITOR POST-MINING TOPOGRAPHY OF <br />BACKFILLED AND REGRADED SURFACES OF THE DISTURBED AREA AT THE TRAPPER MINE. <br />MONITORING FOR THIS PURPOSE SHALL CONSIST OF A CONTOUR MAP (CONTOUR INTERVAL <br />NOT TO EXCEED 5 FEET) PRODUCED FROM AN ANNUAL SURVEY UTILIZING FIELD OR <br />AEROPHOTOGRAMMETRIC TECHNIQUES ACCEPTABLE TO THE DIVISION. THE POST-MINING <br />TOPOGRAPHIC MAPS SHALL 8E SUBMITTED TO 7HE DIVISION FOR REYIEW AND APPROYAL ON <br />AN ANNUAL BASIS, COMMENCING IN JANUARY, 1984: <br />An explanation of the reason for this stipulation can be found in Section VXII <br />(Backfilling and Grading) of the November 23, 1982 Findings Document. <br />Permit Revision No. 1 cannot be issued until all statutory notice and public <br />comment requirements have been satisfied, and until bond has been posted. <br />
