<br /> <br />XIII. Fish and Wildlife (Rules 2.04.11, 2,05,6(2) and 4,18) <br />The Division has reviewed the information in the application regarding fish <br />and wildlife resources and mitigation of impacts to fish and wildlife for <br />compliance. This information is found in the permit application in Sections <br />2.4 (pages 2-123 - 2-169), 4.23 (pages 4-6), 4.6 (pages 4-147 - 4-169) and <br />Appendix E. <br />During the course of the original permit preparation, personnel from Utah <br />International contacted the Bureau of Land Management, U. 5. Fish and Wildlife <br />Service, and the Colorado Division of Wildlife in order to determine the <br />extent and nature of surveys needed and to determine the acceptability of pre- <br />and post-mining monitoring methods and mitigation techniques. This <br />information is contained in Appendix E. <br />Several mitigation measures will be undertaken by the applicant to reduce the <br />impact of the mining operations on resident wildlife population. In addition <br />to the administrative censure of wildlife harassment, these measure include: <br />controlled burns and the suppression of uncontrolled fires, the <br />reestablishment of stock watering ponds to replace those destroyed during <br />mining, the placement of raptor perches on reseeded rangeland areas, and the <br />construction of power lines so as to prevent raptor electrocution. <br />Additionally, the applicant will conduct the following wildlife monitoring: <br />monitoring of deer and elk to determine the success of forage improvement and <br />reestablishment, and the extent of continued use of reclaimed and treated <br />areas. Elk calving surveys will be conducted to determine a use pattern of <br />the permit and adjacent area. Raptor nesting surveys will be conducted to <br />obtain nesting data and evaluate effects of mining on raptors during this <br />permit term. <br />Pursuant to Rule 2.07,6(2)(n), and on the basis of available information, the <br />Division finds that the proposed mining and reclamation activities will not <br />affect the continued existence of any threatened or endangered animal species <br />or result in the destruction or adverse modification of their critical <br />habitats. <br />The operation is in compliance with the requirements of this section, <br />XY. Operations Description (Rules 2.05.2, 2.05.3(1), 2.05.3(2) artd 4.01) <br />The general description of the mining operations and facilities for this <br />permit term has been reviewed by the Division for compliance with the Rules <br />and Regulations. This information may be found in the original permit <br />application in Sections 3.0 (pages 3.1), 3.1 (pages 3-2 - 3-18), 3,2 (pages <br />3-19 - 3-21), 3,3 (pages 3-22 - 3-27) and 3.5 (pages 3-37 - 3-50). <br />Additional information has been provided in Trapper Mining, Inc,'s initial <br />Permit Revision No. 1 received February 27, 1987; Trapper's response to the <br />Division's PAR received on May 26, 1987 and additional information received by <br />the Division from Trapper on July 27, 1987. <br />
