S <br />four conditions that had already been recommended by the staff. <br />The fifth condition required certain berming activities for noise <br />protection. And the sixth condition restricted "[p]lacement of <br />[the] asphalt plant to be at least 1000 feet from Mrs. Allen's <br />place." See Exhibit E. These additional conditions addressed (and <br />apparently satisfied) the concerns of Mrs. Allen and Mr. Haines. <br />Id. The other four individuals' concerns could not easily be <br />resolved by adding additional conditions of approval. <br />Mrs. Einspahr was concerned about prairie dogs and odor; Mr. Heinz <br />generally objected to asphalt plants; Mr. Stratton was concerned <br />about the County's duties in these matters; and Ms. Russell didn't <br />like the fact that the agricultural properties in the area were <br />being mined for gravel. <br />After the Planning Commission meeting, the Planning Commission <br />sent a letter to Brannan explaining that the Planning Commission <br />was recommending to the BOCC that Brannan's conditional use request <br />be approved subject to the six conditions--the four conditions <br />recommended by the staff and the two additional conditions that the <br />Planning Commission had added. See Exhibit F. In this letter, <br />however, the sixth condition was modified; it was slightly <br />different from the condition that the Planning Commission voted on. <br />Instead of requiring placement of the plant "1000 feet from <br />Mrs. Allen's dace", the modified sixth condition required <br />placement of the asphalt plant "1000 feet from Mrs. Allen's <br />prooertv." <br /> <br />
