Orphan pit ~ 1981 <br />Phase I and Orphan pit 1982 <br />Phase II <br />1983 <br />It seems appropriate that GEC prepare and submit a proposed time line, similar <br />to that established for the Canon National pit, for the reclamation of the <br />North Orphan pit, to indicate that this operation will be completed this year. <br />TheDi vision is waiting until GEC submits a revised mine plan, much of which <br />has been mentioned above, before continuing the review of your application for <br />a mining and reclamation permit under the new state program. The 120-day <br />deadline, specified in Rule 2.07.4(2)(b), for the Division to prepare a <br />proposed decision approving or denying GEC's new application is June 29, 1981. <br />I am aware that the geology and hydrology portions of GEC's application are <br />being prepared with assistance from the Sma11 Operator's Assistance Program <br />and there is little you can do to accelerate these studies. We are, however, <br />anxious to see GEC's new mining and reclamation plan/sequence. If we can <br />establish that GEC's plan is unusually complex or controversial, the Division <br />can extend the deadline an additional 60 days (Rule 2.07.9(2)(b)), but this <br />may not be possible without benefit of your new mining plans. If additional <br />information is not submitted for review prior to June 22, 1981, the Division <br />will likely be forced into the uncomfortable position of proposing a decision <br />to deny GEC's application which would mean that all mining activities would <br />have to terminate August 15, 1981 until sufficient information had been pro- <br />vided to enable MLRD to approve a new permit. <br />Please keep me posted on the status of the development of your new mining <br />operation plan so we Can avoid the "worst case" scenario outlined above. As <br />always, MLRD will assist GEC in the preparation and presentation of plans and <br />proposals to the extent that we are able. <br />I will look forward to hearing from you. If you have questions regarding these <br />items, please contact me.
