These documents are also <br />submitted to support the Pit 4 backfilling, grading and retopsoiling bond release requested <br />below. <br />On August 8, 1990, Rockcastle requested a partial bond release based upon volume <br />reduction of Pit 4 pursuant to § V2 of the CMLRD Agreement and the July 9, 1990 bond <br />release request. CMLRD inspected the Grassy Gap site to verify the reduction in volume <br />of Pit 4 on September 6 and 7, 1990. On the basis of this inspection, and supplemental <br />information provided by Rockcastle on September 14, 1990, the CMLRD proposed to <br />release $437,696 of Rockcastle's $572,000 reclamation bond. CMLRD's bond release <br />proposal became final on November 13,1990. Consequently, Rockcastle's reclamation bond <br />was reduced to the current bond amount of $134,304. <br />Rockcastle hereby requests an additional partial bond release pursuant to CMLRD <br />Rule 3.032 and § V of the CMLRD Agreement for completion of additional reclamation <br />activities at the Grassy Gap Mine since September 6, 1990. Specifically, Rockcastle requests <br />a release of $81,748 for completion of the following reclamation activities: <br />1. Rockcastle requests the release of $47,842 for completion of backfilling, <br />grading and retopsoiling activities at Pit 4 pursuant to §V2 of the CMLRD <br />Agreement. CMLRD and Rockcastle agreed that the total reclamation costs <br />associated with backfilling, grading and retopsoiling of Pit 4 was $485,538. <br />CMI_RD Agreement § V2.A. CMLRD released $437,696 of Rockcastle's <br />reclamation bond based solely upon backfilling, grading and retopsoiling <br />activities conducted at Pit 4 prior to September 6, 1990. Consequently, <br />Rockca.stle requests that CMLRD release the remaining $47,842 associated <br />with these reclamation activities ($485,538 - $437,696 = $47,842). The <br />enclosed post-mining topography maps indicate that all backfilling, grading <br />and retopsoiling activities at Pit 4 have been completed in accordance with <br />the approved reclamation plan and the CMLRD Agreement. <br />2. Rockcastle requests release of $18,906 for completion of reseeding activities <br />at Pit 4 as set forth in § V3 of the CMLRD Agreement. Rockcastle <br />completed reseeding activities pursuant to its approved reclamation plan and <br />the CMLRD Agreement on November 1, 1990. <br />3. Rockcastle requesu release of $15,000 for completion of road buttressing <br />activities adjacent to the Pit 4 haul road pursuant to § V3 of the CMLRD <br />Agreement.
