-7- <br />Stipulation No. 2 - WFC should commit to survey sediment accumulation <br />as with the New Elk Mine. Due to the limited amount of sediment <br />which accumulates in these ponds a tri-annual (every third year) <br />frequency would be acceptable. <br />Stipulation No. 9 - WFC must address the issues involving the refuse <br />pile construction which have been described in the March 8, 1985 <br />Letter from Candace Thompson and the March 28, 1985 memo from Jim <br />Pendleton. WFC should submit a comprehensive package which <br />addresses these issues and presents all the information required <br />by Stipulation No. 9. Information which has previously been <br />submitted should be included in this package. <br />Stipulation No. 12 - WFC needs to address the impact on stock ponds and <br />windmills in Ciruela and Apache Canyons as described in a memo <br />from Candace Thompson dated November 27, 1986. <br />Stipulation No. 16 - WFC needs to address topsoil replacement depths, <br />as outlined the a Division letter of January 17, 1986. In <br />addition the contingency plan for obtaining coversoil for the <br />refuse pile should be included here. This contingency plan is <br />necessary, because as with the New Elk Mine, WFC is responsible <br />for replacing 4' of non-toxic material until such time that <br />reclamation with less material is proven feasible and approved by <br />the Division. <br />Stipulation No. 17 - Due to the nature of the materials on site, the <br />Division finds that the sampling performed to date for <br />Stipulation No. 17 is adequate. WFC must commit to soil testing <br />and appropriate mitigation based on that testing prior to <br />seeding. Incorporation of this commitment into the permit will <br />fulfill Stipulation No. 17. <br />Stipulation No. 20(G) - WFC must commit to the revegetation standards <br />of Rule 4.15.8 for all disturbed area. The methods submitted <br />pursuant to evaluation of revegetation success are acceptable. <br />Stipulation No. 23 - As we have discussed in previous meetings, <br />although this stipulation is listed as satisfied, the <br />experimental design proposed by WFC will not yield statistically <br />valid results. The Division feels that the mid-term review would <br />be an appropriate time to modify this proposal. <br />
