V. PROPOSED DECISiOiY <br />Based on the findings set forth above, the Division proposes to approve Trapper Iv(ining [nc.'s <br />request for a Partial Phase [I bond release for the Trapper Mine. This proposed decision will release <br />the applicant from liability for topsoil redistribution and establishment of vegetation for those areas <br />shown on revised ivlap 2.0 of the bond release submittal. <br />The Division holds a performance bond of $18,500,00.00 for the Trapper Nline. The approval of the <br />Partial Phase II bond release is only a release from the liability of topsoiling and reestablishing <br />vegetative cover that meets or exceeds the approved reclamation plan for the band release acreages. <br />No bond money will be released so there will be no reduction in the bond amount. The current bond <br />amount will remain intact and is sufficient to assure completion of the remaining reclamation work <br />at the site if the work had to be performed by the Division, including the cost of reestablishing <br />vegetation on any revegetated azeas, should those azeas fail. The Division estimates its cost to <br />complete remaining reclamation work at the site to be $18,279,608.00, as calculated in Trapper's <br />most recent permit renewal, RN-03, which became final June 12, 1998 . <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Board in accordance with <br />Section 3.03.2(6). Public notice of this proposed decision will be published twice in the Craig Daily <br />Press for two weeks as soon as possible. Requests for public hearing must be submitted to the <br />Division in writing within thirty days of the first publication in the Craig Daily Press.
