On September 1, 1989, Wyoming Fuel submitted a permit revision that would add <br />5674 acres to the permit area. This revision opened the area north of State <br />Highway 12 to longwall mining. It also increased the amount of Federal coal <br />acreage from 40 acres to 962 acres. The permit revision was approved on July <br />2, 1990. Aroom-and-pillar operation driven under the Purgatoire River gained <br />access to the coal. Longwall operations were then begun north of Highway 12, <br />in May 1991. <br />In June 1991, KN Energy, Inc. sold the Wyoming Fuel Company to Entech, Inc., a <br />wholly owned subsidiary of the Montana Power Company. In April 1992, Entech, <br />Inc. idled the Golden Eagle Mine. Since that time, mining has been sporadic. <br />Coal is currently being stockpiled at the New Elk Mine facility, five miles <br />west of the Golden Eagle Mine. <br />In May 1992, Wyoming Fuel Company changed its name to Basin Resources. In <br />October 1992, the Division found the application for Succession of Operator to <br />be complete. The proposed decision for this name change is pending. <br />Since the 1988 Findings, there has been one NOV issued. On June 22, 1992, <br />NOV C-92-O10 was issued for failure to submit to the Division the results of <br />the subsidence monitoring program. The proposed penalty of $1,250.00 was <br />issued on July 14, 1992. Abatement for the NOV was accomplished on <br />July 20, 1992 and the NOV was terminated on July 27, 1992. As a result of an <br />assessment conference held on November 3, 1992, the penalty was reduced to <br />$750.00. Failure to sign the assessment conference agreement within the <br />specified time resulted in a Notice and Order to Pay the fixed penalty of <br />$1,250.00 being issued to the operator on November 27, 1992. <br />Section II - Revisions to the Permit <br />Since permit renewal in December 1988, Wyoming Fuel Company has submitted, and <br />decisions were made on, the following revisions for the Golden Eagle Mine: <br />Technical Revision No. 9 was submitted on January 11, 1989 and was approved on <br />March 16, 1989. This involved the installation of a substation with a power <br />drop borehole and an access road. Bond was increased by $10,466.00. <br />Technical Revision No. 10 was submitted on March 7, 1989 and was approved on <br />May 2, 1989. This revision was for expansion of the existing permit boundary <br />by 35 acres in order to facilitate development mining on the eastern side of <br />the anticipated longwall panels. There was no bond increase. <br />Technical Revision No 11 was submitted on March 7, 1989 and was withdrawn on <br />March 23, 1989. The revision was to expand the existing permit boundary by <br />80 acres in order to facilitate development mining on the western side of the <br />anticipated longwall panels. There was no bond increase. A permit revision <br />would be submitted later to cover, among other things, what was in this TR. <br />Technical Revision No. 12 was submitted on April 12, 1989 and was approved on <br />April 20, 1989. Alluvial studies in Santistevan Canyon were to be conducted <br />prior to secondary or retreat mining. Bond was increased by $1,000.00. <br />Minor Revision No. 10 was submitted on April 28. 1989 and was approved with <br />conditions on May 30, 1989. This was for the 1989 exploration program.
